Scratch marks appearing on game

I bought mw3 played it a few times and scratches have appeared on the game (and no its not my xbox as all other games are fine)... i have read all over the internet that people are having the same problems... what a waste of £40 as the place i bought it from wont refund as they say its not there fault... not a happy person :(
