I recently had a car accident I was hit by an oncoming car on a single track road. The driver of the other vehicle admitted that it was his fault. But now says it isn’t

The same insurance company insures both vehicles and has said that they are going to go 50 50. The list below are something’s that we have but the insurance company will not take as evidence. In your opinion would this be correct?

1

The driver of the other vehicle admitted liability in front of witnesses, and we have him on tape admitting fault.

Insurance answer

You cannot use the witnesses as they are either friends or family.

2

There were 3 witnesses to the accident in another vehicle

Insurance answer

You cannot use the witnesses as they are either friends or family.

3

Photographs of the road and the skid marks pointing out the length of the skid which the other car made, taken just after the accident.

Insurance answer

You cannot use photographic evidence which has not been taken by the police

4

Where the accident happened was on a private estate and the other driver was asked a number of times by myself to slow down in front of witnesses who are not friends or family. Also asked to slow down by his employer which he ignored until he had the accident. Where the accident happened is also a highly used public bridal way

Insurance answer

You cannot use this as evidence

5

later that day after the accident we asked for his insurance details, his father came to see us and told us that he was not going to give us his details because it is a private road which means the insurance does not matter, also there was mud on the road so it was not his sons fault.

Insurance answer

You cannot use the witnesses as they are either friends or family.

My vehicle had come to a complete stop and I saw the other vehicle coming directly at me, The other vehicle only then noticed we were there, even thou you have a direct line of view for 100 yards. The skid marks were 5 metres long from the front of my car to where the other car applied his brakes.

Any help in just advising us which is the best way to continue [email protected]
