I rented a car at Alicante Airport from Avis through Monarch airlines. The first car offered was rejected as it stank of tobacco /pipe smoke. I was presented with choice of a further two cars that had just been returned from rental but had to wait for them to be cleaned. I didn't thoroughly check the replacement car as I was more concerned about the smell of the interior. Two weeks later the clutch went on the car and Avis sent out a replacement car on a breakdown truck. I don't speak Spanish but the truck driver gave me the impression that he understiood that the fuel tank was half full and that there was no damage to the car except for the clutch failure.

At the end of the rental period I ws presented with a credit charge bill for wheel/tyre damage and a full tank of fuel amounting to Euros150.66. I refused to authorise the payment. Four days later I received notification that Avis had debitted my Credit card with £384.06 for the disputed 150.66 Euro bill and the garage repair bill for the clutch. Trying to contact Avis to resolve the issue has been impossible. What legal action can I take to get me money back?
