I buy 2 units of blackberry bold 9000 from him, and he never ship that item

I buy 2 units of blackberry bold on 9 december from fernandez (fernandezperezmart@hotmail.com), from the bigining, i just want to buy 1 unit, but he offer me, if i buy 2 units of blackberry bold 9000 as high as US $500, i will get 1 free.. this is our agreement :
1. I pay 50% from totalize that means I pay US $250 to him
2. After I confirm my payment, he will deliver the item
3. After I reacive that item, I pay the ballance

but now, he didn't deliver that item, because I only pay 50% of totalized. He only give to me a fake document of fedex evidence, I have checked to fedex office and fedex employee said, the tracking number that fernandez give to me unused.

I'm very disappointed with him..
