Product was advertised falsely

Product bought through e-bay and pay for as advised on website and e-mail (internet banking).

Product never received- complaints made directly through website and e-bay as well as several answer machine messages left on number (never answered).

Product cost- £109.06. Have advised that an alternative product would be acceptable if agreed (if funds are an issue at present!).

Essentially, this product was advertised falsely as it was not available and the funds were accepted unlawfully, since no service was offered in their place. I feel this issue is theft and should be treated as such and have displayed patience to date in handling the matter.

Have advised that we will travel to collect the cash / alternative item in person if prefered by seller (Mr Suleyman?)
